What Happens When a County Sealer Inspects Your EV Charger?

Most commercial EV charger operators have never seen a county sealer inspection. That's not reassurance — it's a data point. California has approximately 201,000 public and shared-private charging ports. In fiscal year 2024–25, roughly 3,300 were inspected. The math is simple: your charger probably hasn't been checked yet. When it is, here's what to expect.

Who Are County Sealers?

County sealers are local Weights and Measures officials authorized by the California Department of Food and Agriculture to inspect and enforce accuracy standards on commercial measuring devices. Gas pumps, grocery scales, and natural gas submeters all fall under their jurisdiction. Since California's EV regulations took effect, so do commercial EV chargers.

Under BPC §12532, only a county sealer or a licensed Registered Service Agency can legally place a commercial EV charger into service. AB 2037, effective January 1, 2026, extended that authority to chargers operated by public agencies as well.

What Triggers an Inspection?

County sealers can initiate inspections through several pathways:

  • Routine inspection cycles based on registered device inventories
  • Consumer complaints about billing accuracy
  • A tip or referral from another agency
  • A placed-in-service report filed by an RSA that triggers follow-up verification
  • Inspections are not scheduled with the operator in advance.

    What Does the Inspector Actually Do?

    The inspection follows California EPO No. 52, the Examination Procedure Outline for Retail EV Fueling Systems. The process includes:

    **Pre-test determinations** — the inspector identifies which tolerance class applies to your equipment (acceptance or maintenance) and reviews whether the charger has been previously certified.

    **Accuracy testing** — using calibrated reference equipment, the inspector verifies that the charger's internal meter accurately measures kilowatt-hours delivered to the vehicle under load. The charger must perform within ±1.0% for Level 2 AC and ±2.5% for DC fast chargers.

    **Security seal check** — the inspector looks for the RSA seal affixed during certification. The seal must show the RSA registration number and the year it was placed. A missing, broken, or absent seal is documented as a deficiency.

    **Documentation review** — the inspector checks whether a placed-in-service report was filed with the county W&M office within 24 hours of certification, as required under CCR §4085.

    **Post-test disposition** — if the charger passes, the inspector records the result. If it fails, the charger is rejected and tagged out of commercial service until recertified.

    What Happens If Your Charger Fails?

    A failed inspection means the charger cannot legally bill customers until it is recertified by an RSA. Depending on the county, this can also trigger:

  • A formal notice of violation
  • A citation under BPC Division 5
  • Referral to CDFA for enforcement action
  • In repeat violation cases, potential misdemeanor charges under BPC §12510
  • For public agencies, failed inspections can also jeopardize user fee authority and LCFS credit eligibility.

    The Single Best Preparation

    Get certified before the inspector arrives. An RSA certification establishes your documentation chain, affixes the required seal, and files the placed-in-service report that tells the county sealer your equipment has already been independently verified.
